PRENUPTIAL AGREEMENT

THIS AGREEMENT is made as of [DATE], in anticipation of marriage between [PARTY A NAME] ("Party A") and [PARTY B NAME] ("Party B").

1. PURPOSE

The Parties intend to marry on or about [DATE] and wish to define their respective rights and obligations regarding property and support in the event of separation, divorce, or death.

3. PRE-MARRIAGE PROPERTY

  • All property owned by each Party prior to the marriage shall remain their sole and exclusive property.
  • Any increase in value of pre-marriage property belongs to the owning Party.
  • Income generated from pre-marriage property belongs to the owning Party.

4. PROPERTY ACQUIRED DURING MARRIAGE

  • Property acquired during the marriage using joint funds: [JOINTLY OWNED / AS SPECIFIED]
  • Property acquired using separate funds: [SOLE PROPERTY OF PURCHASER]

5. INHERITANCES AND GIFTS

  • Nothing in this Agreement limits the right of either Party to make testamentary dispositions.
  • This Agreement shall be binding upon the estate of each Party.
